Terms and Conditions

Phaway Atacama Ballooning Experience SPA (hereafter ‘Phaway’)
Important: Please ensure that all participating members of your party have been made aware of the following Terms and Conditions.

1. Flight Bookings
Flight bookings can be made online at our “Book Now” page at www.atacamaballooning.com. For more information or assistance with your booking you are welcome to contact us by email at info@atacamaballooning.com or call us +56 9 9675 8949 or +56 2 2666 0611

To confirm and secure your booking, Phaway must receive full and successful payment. We also require guest names, a contact email, a contact phone number, guest weights and RUTs or Passport numbers.

Once full payment is processed you will receive an emailed Order Confirmation and Payment Receipt with your Booking Number. Please bring the Order Confirmation or Booking Number with you to check in for the flight.

To arrange your complimentary pick up in San Pedro please also provide us with your accommodation details. If this information is not available at the time of booking, please advise us by email at least 7 days prior to your flight date.

Flight bookings are valid for 12 months from the date of booking. Validity can be extended by paying the reinstatement fee described in Section 2. Bookings or Vouchers can be upgraded if your original Booking or Voucher is for a flight of a lesser value, by paying the difference.

Treat your Booking as you would any other Airline ticket as our Terms and Conditions are comparable to the rest of the Aviation Industry.

2. Gift Vouchers
Open dated Gift Vouchers or Gift Cards can be purchased and are valid for 12 months from the date of purchase. Gift Vouchers are valid only when a Payment Receipt has been received by the purchaser, indicating payment in full has been received by Phaway.

Gift Vouchers are transferable to other individuals, however only remain valid for 12 months from the original date of purchase. Gift Vouchers are non-refundable and cannot be redeemed for cash in part or in full. 

A Gift Voucher has been redeemed when the trip date has been booked against the Voucher Number. All other terms relating to Rescheduling and Cancellation (Section 5) apply, however the value remains non-refundable.

If you wish to extend the validity of your Gift Vouchers beyond the normal 12 months, reinstatement fees apply: a 6 month extension costs 15%; a 12 month extension costs 30%. Reinstatement fees are non-refundable.

3. Boarding Restrictions
i.    Children must be 6 years or older and must be able to see over the edge of the basket (1.2m high) unaided by object or person. All children younger than 16 years old must be accompanied by a responsible adult.

ii.    Dangerous Goods and Alcohol cannot be carried on board.

iii.    Phaway’s ballooning operation is a No Smoking activity.

4. Guest Responsibilities
i.    Confirmation Details & Check In – Confirmation details will be sent to you by email and you must check them. It is your responsibility to ensure you have received the emailed Order Confirmation details of your flight, and that the details are correct, including guest weights. You must notify Phaway immediately if you do not have the Confirmation details or if it is incorrect. 

ii.    You are required to follow the Check-In procedure outlined in the information we forward to you by email. If you do not follow the check-in procedure Phaway cannot be held liable for any consequences.

iii.    Medical Conditions – All known medical conditions which may affect your ability to fly and participate must be disclosed to Phaway at the time of booking, prior to your flight date, and to your pilot on the morning of your flight. Some conditions such as pregnancy, recent surgery or injuries may preclude you from flying. Phaway will not knowingly fly anyone who is pregnant and reserves the right to refuse to fly a passenger who fails to provide accurate information in advance of their flight. Phaway will not accept liability for injury, illness or unfitness to fly or participate due to any undisclosed condition.

iv.    At no time during the flight should you or a member of your party be under the influence of drugs or alcohol, nor should you take medication that could affect or impair your judgment.

v.    Pilot & Crew Instructions - In the interests of your safety, you undertake to follow the instructions and advice of Phaway pilots and crew, comply with any local codes of conduct and act sensibly and prudently at all times. Phaway will not accept liability for a guest’s failure to comply with any reasonable instructions or advice given by a Phaway pilot or Phaway crew member.

vi.    Personal Belongings - All personal belongings such as cameras, phones, jewellery or other valuables are carried on board at your own risk.

vii.    Footwear and Clothing - Guests should wear clothing suitable for an early morning walk in the desert including enclosed footwear, long sleeved shirts and long trousers preferably made from natural fibers. No flip flops, and white or light coloured clothing are discouraged. Phaway will not accept liability for damage to any clothing or attire.

5. Cancelations, Rescheduling and Failure to Show
Should you need to reschedule or cancel your flight booking, conditions apply. You must notify Phaway by email of any alteration, reschedule or cancellation request.

Up to 21 days before the flight departure - A flight may be rescheduled without fees. Cancellations will be charged a fee of 20% of the booking cost, with the balance of the booking refunded.

Within 21 days before the flight departure - Bookings cancelled within 21 days of the flight departure incur a 100% cancellation fee of the booking price. Flights cannot be rescheduled within 21 days of the flight departure.

Failure to Show will not be refunded or rescheduled - Under no circumstances will flights be refunded or rescheduled if passengers cancel or do not turn up for their scheduled flight at the appointed time. You will not be eligible for any refund in part or in full, and may not reschedule your booking to another date. 

In case of unforeseen circumstances including being unable to fly due to illness, we recommend that passengers arrange their own insurance provisions.

Please note;
•    You cannot receive a refund on any flights booked with a Gift Voucher or Gift Card.
•    Phaway reserves the right to amend these terms. When special circumstances arise, these Terms and Conditions may be superseded by those published on your Booking Confirmation email.
•    Separate cancellation and alteration provisions apply to large groups and customised events. Refer to your Booking Confirmation documentation.

6. Ticket Transfer – Flight Tickets are transferable. Passenger changes should be notified by email at least 7 days prior to the flight date, detailing the new guest’s name, contact email, contact phone number, weight, and RUT or Passport number. 

7. Weather, Mechanical, Safety, Staffing & Other Conditions
Hot air ballooning relies on suitable weather conditions in order to proceed safely. Wind direction, wind speed, mechanical performance, staffing availability or other variables may require us to cancel, delay or alter a flight. When conditions are deemed by Phaway to be unsuitable or unsafe to proceed, flights may not go ahead as scheduled.

8. Flight Cancellation – Refund or Reschedule
If your flight does not proceed due to weather, mechanical, safety, staffing or equipment conditions please contact our office as soon as possible to reschedule or receive a full refund. If rescheduling, we will hold your payment in credit for a flight in the twelve months from the booking date. Please allow up to 45 days for credit card refunds.

9. Shortened Flight
If due to considerations such as safety, a flight is shortened to less than 30 minutes, it will be refunded up to 50%.

10. Insurance
Phaway carries third party and passenger liability insurance for each of its balloons provided by Lloyd’s Underwriters.

11. Liability
Phaway endeavours to give each passenger the best ballooning experience possible subject to the daily weather conditions and all safety considerations. Phaway will not accept any liability for travel, accommodation, disappointment, inconvenience or other costs incurred or lost due to a flight delay, alteration or cancellation.

12. Alteration or Revision
 Phaway reserves the right to alter or revise its Terms and Conditions or rates at its discretion.

13. Acceptance of Terms
These Terms and Conditions apply to all Flight Bookings and/or Gift Vouchers or Gift Cards purchased from Phaway, its agents or representatives. Your acceptance of these Conditions is a term of supply of Phaway’s services. By booking or scheduling a flight, or purchasing a voucher, you are accepting supply of the services, and you are agreeing to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions you should contact Phaway immediately and prior to accepting supply of the services.
